What happens as a married couple once I change my gender marker in filing Taxes jointly and what happens in terms of State Taxes in Maryland where we have been married for 28 years ,filing jointly, but that state does not recognize same sex marriage. Our accountant can not get a straight answer from the bureaucrats so thought I might ask here. Thanks Susan

You know, the state of Maryland doesn't really care what your gender is as long as you pay your taxes. I wouldn't mention it at all. Just go on filing as you always have. Why even bring it up? Your accountant and his bureacrats are overthinking this situation. Do you have a same sex marriage? No, you do not. You were married 28 years ago in a man-woman, regular, ordinary, garden variety marriage. That marriage is perfectly legal and can only be disolved by divorce or death. It will remain no matter WHAT you do. So don't make a mountain out of a molehill. Be a good girl and pay your taxes as you always have. You will be fine.

It would be best to ask someone who knows the tax laws regarding your state. If the state does not recognize same sex marriage, my advice is to hold off on filing until you hear it from someone who does know the proper answer, that you won't run it any potential legal problems should it be an issue since it can be an issue in many states.

She's NOT in a same sex marriage... She doesn't need to worry about this.

Unless some action is taken to divorce or anul the marriage then it remains valid. Many states don't recognize the change of gender anyway.
Darn, I thought that I found an answer to the "marriage penalty!" :)

Your SS# does not say what clothes you are wearing; so file as you did in the past.

My concern would be that if you are filing a joint return and you both have female names, that alone might flag an audit.

Guys names who have feminine sound: Tracy, Erin, Jackie, I know a GG who is Jimmie. Micheal Learned was on Little house. Ann Miller's real name was Johnnie. I don't think that would bring up a flag.
To the computer your name is just a string of letters and enough people have odd names that you won't be noticed. As long as you pay they won't have a complaint.

Add a tail, and paint your butt red.. take a photo and attach it to your tax return.. Trust me.. your check will be cashed just as it has been for... the past 28 years.:heehee:

If you are married prior to gender change then you will remain to be married. It is treated the same as a simple name change. They can call you Dumbo the Elephant and you would still be married. Until they get a court to order that the marriage is dissolved then you are married.
