if there is not a unisex choice offered then I use the one that matches my presentation, that is the way the law reads in SF

to be safe, I would suggest that you use the ladies when dressed as a lady and vise versa. It looks stupid when a lady walks into the gents room and not cool for a guy to enter the ladies domaine!!!!!
