Hi! I'm a MtF TG, very early in my process. I'm trying to anticipate problems before I hit my pretty nose on them. One of them concerns the change of name and gender in official document. I was born in Canada and lived there until I moved in California, 3 years ago. And I plan to stay here for a while.

I'm afraid to fall between 2 chairs, since I read that Canada requires you to live in Canada for a year before allowing you to request a name or gender change, and I would not be surprised if Social Security requires an updated birth certificate from Canada before proceeding with the name change in the US...

Are there any TS from Canada that went through a similar situation? Any recommendations?

Love,

Melanie

I found a similar reference to that for Quebec, but not in the other provinces I found information on. You would have to use the rules of the province you were born in, since birth registration is a provincial responsibility. Which province were your born in?

Hi tess-leigh, I am also from Quebec. I'd like to avoid going back for a year to perform the name change...

The official description of the procedure, in French, as at
http://www.formulaire.gouv.qc.ca/cgi/affiche_doc.cgi?dossier=6989&table=0&

My French is a bit rusty, but the appropriate clause does appear to say that the person must have been living in Quebec for at least one year. Which I think could be attacked on Charter of Rights grounds about free movement between provinces, but fighting that battle in court would probably take more than a year.

The description is for the change of gender, and requires that gender reassignment surgery have been completed. I gather you aren't at that point yet. Until you are, you probably will just have to do a name change, which I suspect does not require the 1 year residence.

The summary I looked at of gender change laws across Canada all required proof of surgery, for the provinces that were included in the summary. Changing name should not require proof of anything (other than original identity.)
